CONCLUSION OF AUCTION: All successful bidders will receive a Real Estate Purchase Agreement through email or other means and are required to complete and properly sign without any modifications immediately following the conclusion of the bidding through email or delivered in person to Herron Auction and Realty by 4:00 PM of the day following the auction. Along with the completed, signed contract, the Winning Bidder(s) will be required to pay the specified non-refundable earnest money deposit as stated in the terms and conditions of auction. This non-refundable earnest money deposit will be held in escrow until closing and that amount will then be credited to the Buyer(s) as part of the purchase price of the property. Successful bidder(s) not executing and returning the completed contract and earnest money deposit by 4:00 PM the day after the auction will be considered in default. Such default by the successful bidder(s) will result in that bidder’s liability to both the Seller and Herron Auction and Realty Inc. Seller shall have the right to (a) declare this contractual agreement cancelled and recover full damage for its breach, (b) to elect to affirm this contractual agreement and enforce its specific performance or (c) Seller can resell the property either publicly or privately with Herron Auction and Realty Inc. and in such an event, the Buyer(s) shall be liable for payment of any deficiency realized from the second sale plus all costs, including, but not limited to the holding costs of property, the expenses of both sales, legal and incidental damages of both the Seller and Herron Auction and Realty Inc. In addition, Herron Auction and Realty Inc. also reserves the right to recover any damages separately from the breach of the buyer. Both the Successful Bidder(s) and Seller shall indemnify Herron Auction and Realty Inc. for and hold harmless Herron Auction and Realty Inc. from any costs, losses, liabilities, or expenses, including attorney fees resulting from Herron Auction and Realty Inc. being named as a party to any legal action resulting from either Bidder(s) or Sellers failure to fulfill any obligations and undertakings as set forth in this contractual agreement.
BIDDING INFORMATION
This is an online only real estate auction conducted with the properties to be sold individually.
*Auction End Times: Herron Auction and Realty Inc. online only auctions are timed events and all bidding will close at the specified time. Bidders who desire to make certain their bids are acknowledged, should place their bid in ample time before the close of the auction. This online only auction will feature an ‘AUTO EXTEND’ timer. If a bid is placed on any parcel in the final 5 minutes of the auction, the lot being bid on will remain open for an additional 5 minutes. if any further bidding occurs, the extension timer will reset to 5 minutes. If no further bidding occurs, the lots close when the timer runs out. Other lots will continue to close out while active lots remain open. The online bidder is responsible for monitoring their bid to the close of the auction. Herron Auction and Realty Inc. will bear no liability/responsibility in case of bidder error.
The auctioneer shall have full discretion to modify this end time and extension tie which will be announced to the bidders.
Seller reserves the right to approve or reject any final bid.
Malfunction and loss of service: The results of the auction may be rendered void if a malfunction or technical difficulties occur related to the server, software, internet, or any other auction related technologies. In such an event, Herron Auction and Realty Inc. reserves the right to remedy the situation in whichever way best represents the seller, including extended bidding, continue the bidding by any means necessary, close the bidding, or cancellation of existing bids. Neither the company providing the software nor Herron Auction and Realty Inc. shall be held responsible for a missed bid or the failure of the software to function properly for any reason.
YOUR BID ON THIS AUCTION INDICATES BOTH AN UNDERSTANDING AND AN ACCEPTANCE OF THE TERMS OF THIS CONTRACTUAL AGREEMENT BETWEEN YOURSELF AND BOTH THE SELLER AND Herron Auction and Realty Inc. AND THAT YOU, AS THE BIDDER, ARE PREPARED TO PURCHASE THE PROPERTY UNDER THE TERMS AND CONDITIONS OF THIS AUCTION.

Bidding rights are provisional and the Auctioneer reserves the right to decline registration or bidding privileges at their discretion if there is any question to a persons credentials, identity, mental fitness, etc.
Early registration is encouraged to receive property updates and notices of any changes.
Registrants must provide copy of a valid state-issued ID.
Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account.
CONTRACT & EARNEST MONEY & BUYERS PREMIUM: Successful high bidder(s) shall sign the auction purchase agreement immediately after the auction (in person or electronically).
A Five Percent (5%) buyers premium will be added to the final bid. The buyer’s premium, together with the final bid amount, will constitute the total purchase price of the Real Estate. (Example: Hammer Price $100,000 plus 5% Buyers Premium equals Contract Purchase Price of $105,000).
A non-refundable 10% down payment of the Contract Purchase Price in the form of cash, good check, or wired funds in USD are due immediately following the auction or no later than 4:00PM the following day. (Example: Hammer Price $100,000 + 5% Buyer’s Premium $5,000= Contract Purchase Price $105,000 with a 10% down payment of $10,500).
Checks are to be made to Herron Auction and Realty Inc. and will be deposited in the broker/auctioneers escrow account until closing. If a wire is used please contact Herron Auction and Realty Inc. for wiring instructions.
CLOSING: All Auctions are to be considered a cash sale and the balance of the purchase price shall be due in 40 calendar days on or before August 9th 2026. If the buyer chooses to obtain financing for the balance of the purchase price, completion of this transaction is not based upon the condition of successfully obtaining financing nor is it subject to a satisfactory appraisal or inspection of any kind. Herron Auction and Realty Inc. is not to be considered a closing title agent. A third party closing title attorney will prepare documentation and monetary disbursements required at closing. All closing costs and wiring fees are the buyer’s expense.
PROPERTY DETAILS: Possession: Possession will be given at closing and considering tenants rights.
TAXES: 2026 Real Estate taxes will be pro-rated to the date of the closing.
DEED: Seller shall provide a a general warranty deed conveying title to the property at closing. Deed preparation will be the expense of the seller.
